JOINT ADMINISTRATIVE ORDER 11-4

RE: TEMPORARY DETENTION BY SHERIFF'S PERSONNEL

IT IS HEREBY ORDERED THAT:

EFFECTIVE IMMEDIATELY AND UNTIL FURTHER ORDER OF THIS COURT,

If any person entering the Juvenile Court Center is stopped and temporarily detained by sheriff's personnel for suspected violation(s) of law, the following procedures will be followed:

1. If the person stopped and temporarily detained is immediately released without being arrested or detained for further investigation, that person will be allowed to pursue his or her legitimate business within the building, without interruption.

2. If the person stopped and temporarily detained is removed from the entrance area to the Sheriff's Office or to some other security area, either under arrest or for further Investigation, the Sheriff's personnel will:

   a. Notify the State's Attorneys Office of the arrest or detention.
   
   b. Ascertain the person's name and business within the building.
   
   c. If the person is here for a scheduled court appearance, either as a party or as a witness, the Sheriff's personnel will immediately notify the court personnel where the person is scheduled to appear of the fact of his or her detention or arrest, and the area where the person is being detained.
   
   d. If the person is here for any other legitimate business, the Sheriff's personnel will immediately notify the Department or Agency with which the person has business of the fact of his or her detention or arrest, and the area where the person is being detained.

3. Should any party in the waiting area be arrested on an outstanding warrant, in addition to the above procedures, parties respondent must be brought before the judge with whom an appearance was scheduled before being transported out of the building.

Attorneys and Juvenile Court personnel affected by the person's detention or arrest will be allowed to communicate with that person relative to their court business.

This Joint Administrative Order supercedes Joint General Order 09-4.

This order is entered this date, February, 22, 2011, and shall be spread of record and published.
